These General Conditions have as their object the purchase of products and services, carried out remotely via the internet on the site https://www.nardone.it/shop/ belonging to ITAN of the Nardone brothers.
The sale is governed by these General Conditions. The Customer is therefore invited, before sending the order, to carefully read the general conditions of sale as identified above and the information contained therein and to print or save them on another durable medium accessible to him.

The site was created for the sale of food products, in compliance with the Italian legislation on distance contracts, Legislative Decree no. 70/2003.

The sale is governed by these General Conditions:

– The Customer can purchase the products contained within the NARDONE.IT/SHOP site, the publication of the same products within the site represents an invitation to the customer to make a purchase proposal. The order sent by the Customer has the value of a contractual proposal and implies full knowledge and full acceptance of these General Conditions of Sale.
The correct receipt of the Customer’s proposal is confirmed by nardone.it/shop through an automatic reply sent to the e-mail address supplied by the Customer and only confirms the correct receipt of the proposal within the information systems.

Acceptance of the general conditions of sale:

– The contract stipulated between nardone.it/shop and the Customer must be considered concluded with the acceptance, even if only partial, of the order by nardone.it/shop.

This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

– If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation on distance contracts.

– Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial, of an order.

– The order sent by the Customer to nardone.it/shop through the Internet must be completed in all its parts and must contain the elements necessary for the identification of the Customer and the packages ordered and the indication of the place of delivery, under penalty of its nullity.

If there are problems with delivery due to incorrect addresses, ITAN of the Nardone brothers undertakes to return the package at the expense of the customer.

– By sending the order, in the various ways provided for in the operating instructions of the Site, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the General and Payment Conditions described below.

– All product prices are clearly indicated on the Site and are inclusive of VAT. Shipping costs are indicated based on the quantity purchased and the place of shipment.

MINIMUM ORDER 3 KG

– If a package is presented on the Site with the item “out of stock” or in any case without the opportunity to be placed in the cart, it is considered not available for sale through the Site.

– The prices of the products, as shown on the Site, are subject to change at any time and without notice, it being understood that, limited to orders being accepted or as accepted above by ITAN of the Nardone brothers, the current conditions of sale will apply. at the time the order is sent by the Customer, except for orders not accepted.

– Once the ITAN order from the Nardone brothers has been received, it will check the availability of stock for order fulfillment. In the event that a package is not available, the ITAN Customer Service of the Nardone brothers will promptly notify the Customer and proceed with the cancellation of the order.

If the delivery times of the ordered product are delayed with respect to the delivery times indicated on the Site prior to the order, ITAN by the Nardone brothers undertakes to promptly notify the Customer via an e-mail message to the address indicated by the Customer. Until the time of shipment by ITAN of the Nardone brothers, communicated to the Customer through an e-mail message, the Customer has the right at any time to cancel the order or modify it, exclusively by sending an e-mail to the customer care address dedicated nardone@nardone.it, the image of the packages themselves has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics but differ in color, size, accessory products shown in the figure.

In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

Terms of payment
– Payments in execution of the Purchase Contracts stipulated through the Site can be made through Bank Transfer, Credit Card, Stripe and Cash on Delivery. The Customer, at the time of the conclusion of the Purchase Agreement, after verifying the summary of the order and carrying out the necessary checks, will confirm the operation. At this point, the Customer’s browser is automatically redirected to the site responsible for payment, reporting the summary data of the order and the parameters necessary for completing the transaction. The browser connects to the page containing a mask in which the customer must enter the data relating to his credit card with which he intends to make the payment.

– In cases of purchase of goods with a credit card payment method, at the same time as the online transaction is concluded, the reference bank will only authorize the commitment of the amount relating to the purchase made, including shipping.
The amount relating only to the goods dispatched, even partially, will actually be charged to the Customer’s credit card upon confirmation of the purchase.

-The customer can decide to pay the brand on delivery with a surcharge.

– ITAN of the Nardone brothers reserves the right to request additional information from the Customer (e.g. landline phone number) or to send copies of documents proving ownership of the card used.
In the absence of the required documentation, ITAN of the Nardone brothers reserves the right not to accept the order.

In case of cancellation of the order, both by the Customer and in case of non-acceptance of the same by ITAN of the Nardone brothers, ITAN of the Nardone brothers will be requested at the same time by ITAN of the Nardo brothers to cancel the transaction and release the amount committed.

The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry date (typically 24-25 days from the date of authorization).

– For greater customer guarantee and security, at no time during the purchase procedure is ITAN of the Nardone brothers able to know the information relating to the buyer’s credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction.

In no case can ITAN of the Nardone brothers be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment for products purchased on nardone@nardone.it.

Deliveries and documentation ITAN of the Nardone brothers undertakes to deliver within 5 working days or in any case within 7 working days of payment confirmation, for shipments made to the islands the delivery time will be within 10 working days of payment confirmation.

All product deliveries will be at the risk of ITAN of the Nardone brothers.
The risk will be transferred to the Customer upon delivery of the products to the Customer by the shipper, carrier or other agent appointed by ITAN of the Nardone brothers for delivery.
Upon delivery of the goods by the courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document, that the packaging is intact, not damaged, nor wet or otherwise altered, even in closing materials (adhesive tape or plastic straps).
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set out in this document.
In the event of failure to collect within 5 working days of the material in stock at the courier’s warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of the order, the order will be automatically canceled.

Right of withdrawal
Pursuant to Legislative Decree 06/09/05 N ° 206, the consumer customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 10 days of delivery of the products.

To exercise this right, the customer must send a written communication by registered letter with acknowledgment of receipt to ITAN of the Nardone brothers, c.da Ilici zone PIP Italia, 83030 Venticano (AV) or to the dedicated e-mail address nardone @ nardone .it the package or packages for which it intends to exercise the Right of Withdrawal, as long as it is intact.

Once the aforementioned notice of withdrawal has been received, the Customer Service will quickly communicate to the customer the instructions on how to return the goods.

• The right of withdrawal is however subject to the following conditions:
• the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
• the right of withdrawal does not apply to goods made to measure or personalized.
• The purchased good must be intact.

By law, the shipping costs for returning the goods are charged to the customer;
The shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
In the event of damage to the goods during transport, ITAN by the Nardone brothers will notify the customer of the incident, to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal;
ITAN of the Nardone brothers is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
ITAN of the Nardone brothers makes available to the customer the possibility of sending the goods with insured shipping by express courier. If the Customer chooses to use the facilitated return service, the related costs will be deducted from the amount due to the Customer for the withdrawal.
Upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, ITAN of the Nardone brothers will deduct a percentage from the refund due, in any case not exceeding 20% ​​of the same, as a contribution to the restoration costs.

Without prejudice to any repair costs for damage to the original packaging, ITAN of the Nardone brothers will refund the customer the full amount already paid, within 30 days from the return of the goods, by means of a reversal of the amount charged to the credit card. or by bank transfer. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the reimbursement (ABI Code – CAB – Current Account of the invoice holder).

The right of withdrawal is totally lost, due to lack of the essential integrity of the goods (packaging and / or its contents), in cases where ITAN of the Nardone brothers ascertains:

• the lack of the external packaging and / or the original internal packaging;
• the absence of integral elements of the product;
• damage to the product for reasons other than its transport.

In case of forfeiture of the right of withdrawal, ITAN of the Nardone brothers will return the purchased good to the sender, charging the shipping costs to the sender.

Complaints
Any complaint must be addressed to ITAN of the Nardone brothers, c.da Ilici, PIP Italia area, 83030 Venticano (AV).

Applicable law
The sales contract between the customer and ITAN of the Nardone brothers is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his / her town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Benevento.
